Introduction-

In 2007 Cauvery Water Disputes Tribunal (CWDT) in its final award with respect river water sharing between four riparian states/UT proposed the setting up of Cauvery Management Board (CMB). The objective of CMB was to share water among riparian states in deficit years based on water sharing among them in normal years.

Role of Cauvery Management Board-

  • During monsoon deficit years, the pattern of flows in the different sub-basins will not match the schedule of water deliveries worked out on the basis of normal year readings.
  • The CMB was conceived as a body that would monitor the storage position in the Cauvery basin and the trend of rainfall, and assess the likely inflows for distribution among the States.
  • Cauvery Management Board (CMB) will permanent solution to river water sharing in deficit years by understanding the ground realities. It will reduce the burden of judiciary as it will be vested with power and functions.
  • It will consist of representative of each states and also technical experts on this matter, so that decision can be taken without affecting the interest of any state.

Issues in setting up of Cauvery Management Board-

  • Article 262 of the Constitution and the provisions of the Inter-State River Water Disputes Act, 1956 forbids the Judiciary from intervening in inter-State water disputes.
  • Similarly various appeals against tribunal order are pending before judiciary, and the three-judge Bench of the Supreme Court is already seized of the matter.
  • The CMB has to be formed by act of Parliament, as matter is already politicized to large extent, hence many argued that it may not be right time to set up CMB.

Conclusion-

Cauvery river water dispute is very old dispute mainly between Karnataka and Tamilnadu, and the matter is politicized to the large extent, hence there is an urgent need find long term solution to this problem. In this background CMB will definitely play role in solving problems in deficit years. Hence centre should take all states on board and form CMB.
