Q. Impact of South China Sea verdict: Discuss the impact of China’s stand on recent tribunal judgement on China’s super power aspiration.
Jul 14, 2016 Related to : GS Paper-2

Ans :

Recently the tribunal (Permanent Court of Arbitration) in The Hague has effectively thrown out China's nine dash line which asserts the country's claim to most of the South China Sea. The tribunal found that such historical claims - in China's case going back hundreds of years - are superseded by the United Nations Convention on the Law of the Sea.

China’s stand on judgement-

  • China has rejected the unanimous ruling of an international tribunal at The Hague, which ruled China has no legal basis for much of its claims on the South China Sea.
  • China claims that the tribunal in The Hague lacks jurisdiction in this matter and dismissed the ruling.

Impact of China’s stand on judgement-

  • Though there is no mechanism to impose international law on sovereign states, but it holds up norms and, in the present instance, China comes across as a violator of international norms.
  • China’s immediate response of rejecting tribunal verdict has heightened tension in the region. Nations across world will force China to comply the verdict, failing to comply will affect China’s aspiration as a global power.
  • For China, which sought to challenge the influence of the United States in the region, the ruling is a setback. Outright rejection of international laws has long bearing impact on China’s global aspiration.
  • The setback at The Hague comes at a critical juncture in China’s bid to bolster its global economic status. This relates to its long-standing ambition to be accorded recognition as a market economy under the World Trade Organisation will be definitely affected by China’s stand on tribunal verdict.

The recent judgement by tribunal at The Hague has significant impact not only in the region, but also on global lines. Similarly outright rejection of international law will bear significant impact on China’s ambitions. If China is serious about its ambition of global power, it should reach a negotiated settlement of its disputes in the South China Sea.
