Dec 23, 2016 Related to : GS Paper-2

Ans :

Recently European Union (EU) has issued warning to Poland over concern of erosion of rule of law in Poland. The conservative Law and Justice Party government in Poland has repeatedly tinkered with and undermined the institutions of democracy in the country, progressively tightening its grip over them.

  • Various actions of government reflect its intention to control the Constitutional Tribunal, Poland’s highest court. Recently the outgoing president of the highest court, alleged that the government was out to destroy the tribunal.
  • For example, action that have impacted judicial functioning include publishing judgments selectively and passing legislation to temporarily appoint the head of the Constitutional Tribunal.
  • Among the government’s moves are the replacements of heads of public bodies with its loyalists, a ban on abortions (rolled back after protest), a campaign to control NGOs, curbs on media freedom etc.

What’s next?

  • The EU has issued strong concerns against the actions of Poland Government and it has given Poland two months for a course correction.
  • If Poland Government fails to correct its actions, EU could eventually strip Poland of voting rights in the European Council, an unprecedented action.

Ongoing actions of are reflection of grave concerns over the developments in Poland and government has continuously undermined the institutions of democracy in the country. Already EU has warned Poland many times, if Poland government continues its anti democratic actions then it may lose voting rights in EU Council.
